Service Agreement

This document governs your use of BEST QUALITY SERVICE TRANSPORTATION's services, including freight brokerage, shipping, and warehousing. By engaging our services, you acknowledge and agree to the following provisions designed to ensure operational excellence and legal clarity.

1. Definitions

To ensure clarity in all communications and contracts:

  • Shipper: The party or entity whose goods are being transported.
  • Carrier: The entity that provides the physical transportation of the cargo.
  • Broker: BEST QUALITY SERVICE TRANSPORTATION LLC, acting as the intermediary to arrange transportation services.

2. Brokerage Agreement

BEST QUALITY SERVICE TRANSPORTATION LLC is a licensed freight broker. Our primary role is to arrange for the transportation of freight by authorized motor carriers. We do not transport the cargo ourselves but serve as the critical link in the supply chain to ensure your goods move efficiently from origin to destination.

3. Payment Terms

Payment for services rendered is due within 30 days of the invoice date unless otherwise specified in writing. Invoices are generated upon successful pickup or delivery as agreed. Late payments are subject to a 1.5% monthly interest fee. Failure to settle outstanding balances may result in a suspension of shipping privileges and the pursuit of legal collection remedies.

4. Liability and Claims

As a broker, our liability is limited to the negligent performance of our duties. Physical cargo loss or damage claims are the responsibility of the Carrier. All claims for loss, damage, or delay must be filed within 9 months of delivery, accompanied by documented proof of loss and the original BOL (Bill of Lading).

5. Warehousing Terms

Goods stored in our facilities are subject to specific warehousing conditions. BEST QUALITY SERVICE TRANSPORTATION LLC maintains a warehouseman’s lien on all goods for charges incurred. Liability for stored goods is limited to a specific value per pound unless a higher value is declared and additional insurance premiums are paid by the client.

6. Incoterms

All international and specific domestic shipping agreements will be governed by the Incoterms® 2020 rules as published by the International Chamber of Commerce. The specific rule (e.g., EXW, FOB, DDP) must be clearly stated on the purchase order or shipping instructions to define the point of risk transfer.

7. Governing Law

These Terms of Service and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Massachusetts, without regard to its conflict of law principles. Any legal action shall be brought exclusively in the courts located in Suffolk County, MA.
